What is Mediation?

Mediation is an age old process that is an effective way of managing conflict and disputes.  Mediation is a confidential conversation between parties in dispute.  

The conversation is moderated by a neutral (mediator) who frames the discussion in a way that exposes both party’s positions and interests.  The dispute or “problem” is examined for possible compromise.  If that is the case, parties are encouraged to negotiate their interests in a collaborative fashion.  

Mediation is interdependent.  All parties must agree or there is no agreement.  If mediation fails to produce a satisfactory conclusion, other venues exist.  Parties may escalate the process by arbitrating the matter or, of course, litigation.

When is Mediation Appropriate?  

Mediation is uniquely appropriate for parties in on-going relationships such as employees, family members, neighbors, business partners.  Mediation promotes communication and empowers individuals to articulate, defend and negotiate a conclusion to their dispute.
